Fed. Court Throws Out GOP Lawsuit Before It's Even Filed

Well, OK, technically this isn't the same lawsuit that Speaker of the House John Boehner (that's "John Boehner", by the way, not "Ted Cruz" or "Mitch McConnell") is still supposedly planning on filing against President Obama, but it might as well be:

A federal appeals court has summarily tossed a lawsuit challenging the Obama administration’s delay of Obamacare’s employer mandate — a case that is similar to the one that House Republicans plan to file against the president.

This suit was filed by the Association of American Physicians and Surgeons, which argued that the delay could hurt doctors financially. But the 7th Circuit Court of Appeals in Chicago on Friday said the plaintiffs don’t have a right to sue.

A unanimous three-judge panel threw out the case only three days after oral argument, a breakneck speed.

Of course, the official GOP lawsuit hasn't actually been filed yet for several reasons, one of which is that Boehner seems to be having trouble getting a law firm to actually file it...

The House has not yet filed the lawsuit. On Friday, the House replaced its lawyers after the previous attorney pulled out, citing pressure from other clients for the political nature of the suit, according to House staffers.

Oh, yeah, and for those wondering why the Republicans--who, you'll recall, have voted more than 50 times to repeal the law--are suing the President in the first place, it's because he delayed the employer mandate of the law by a year.

You know, the employer mandate that they despise and have been desperately trying to get rid of altogether for 4 years now.
